Terms of Service

1. The agreement
By creating a Coldops account you agree to these Terms. If you use the Service on behalf of a company, you represent that you can bind that company.
2. The Service
Coldops monitors campaign data from sending platforms you connect, detects issues, sends alerts and generates AI-drafted summaries. Coldops reads data via the platforms' official APIs using credentials you supply; you are responsible for having the right to connect those workspaces.
3. Acceptable use
You may not use the Service to violate any law, including anti-spam laws (CAN-SPAM, GDPR, CASL) applicable to your outreach; attempt to access other customers' data; resell the Service without written permission; or reverse engineer it. We may suspend accounts that threaten the integrity of the Service.
4. Trial, billing & cancellation
Every new account starts with a 14-day free trial, no card required, of the full product. If the trial ends without a subscription, monitoring and alerts pause; your data is retained, and monitoring resumes on the mailbox allowance of the plan you subscribe to. Subscriptions bill monthly or yearly in advance via Stripe and renew automatically. You can cancel anytime from the billing portal; access continues until the end of the paid period, after which monitoring pauses in the same way. Fees are non-refundable except where required by law or under our 30-day money-back guarantee.
5. Your data
You own your data. You grant us the limited right to process it to provide the Service, as described in the Privacy Policy. We may use anonymized, aggregated statistics (never identifying you or your clients) to improve the product. If you enable the anonymous-benchmarks option in Settings (it is off by default), your sending metrics are additionally included in cross-customer benchmark aggregates, published only as percentiles over groups of at least 10 organizations and never as identifiable rows.
6. Disclaimers
The Service is provided "as is". Monitoring depends on third-party APIs that can change or fail; we do not guarantee that every issue will be detected or that alerts will always be delivered. AI-generated content may contain errors — review it before sending it to your clients. Nothing in the Service is legal or compliance advice.
7. Limitation of liability
To the maximum extent permitted by law, our total liability under these Terms is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost client retainers.
8. Termination
You may delete your account at any time. We may terminate accounts that breach these Terms with notice where practicable. Sections 5–7 survive termination.
9. Changes
We may update these Terms; material changes will be emailed to account holders at least 14 days in advance. Continued use after the effective date constitutes acceptance.
